This case is a about a boy who is accused of having killed his father and another man. Instead of doing their home work, prosecutors in Arizona use their PR machine to re-convict the 8-year old boy for a double murder he highly likely did not commit. This is another Nifong case in the making. Lets look at the published facts. Quoting the prosecutor the New York Times reports: An 8-year-old Arizona boy charged with premeditated murder in the deaths of his father and another man shot each victim at least four times with a .22-caliber rifle, methodically stopping and reloading as he killed them. Prosecutors said the murder weapon was a single-action .22-caliber hunting rifle that requires reloading before each shot. He had to eject the shell from the rifle and put in a new shell each time he fired, Mr. Carlyon said. Now lets look at the circumstances. Here we have two adults, one 29 years old and physically quite able to defend themselves, and another man believed to have been of a similar age and physical fitness. The boy walks up to them and shots one of the adults, then ejects the shell from the rifle and reloads the gun, all while the second adult is standing by, probably telling the boy to bring it on. Right. The facts the boy gave the investigator during a police interrogation were quite different. He reported that the two had been shot by somebody, that he discovered them and ran to a neighbor to report the death. Using their authority figures to intimidate the 8-year old they finally got from him what they called a confession. The boy was not read the Miranda rights, neither his mother nor an attorney was present. His so called confession is useless and will be thrown out. If the case in fact goes before a jury, any even remotely capable attorney would ask how an 8-year old can shot one man, then reload the rifle, while the second man stands by. What is so troubling is that reporters working for the New York Times, for USA Today and other media outlets lack the absolute minimum analytical skills to question facts that are obviously inconsistent. What is even more troubling is the incompetence of the CSIs investigating the case, the law enforcement officers interrogating the boy, and the prosecutor who stoops to the Nifong level to poison the jury pool.
